2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Section 140 (2) of the Bhartiya Nyaya Sanhita.

3. The case of the prosecution is that the informant received a call from the mobile of Rohit Kumar that the son of the informant is with him and he demanded Rs.10 Lakhs as ransom.

4. Learned counsel for the petitioner submits that the boy was recovered and he has given his statement. In his statement he has not named this petitioner. The name of the petitioner has surfaced on the basis of confessional statement

Patna High Court CR. MISC. No.80209 of 2024(3) dt.25-02-2025 2/2 of the co-accused. The petitioner is having no criminal antecedent and he is in jail since 17.07.2024.

5. Learned APP appearing for the state has opposed the prayer of regular bail of the petitioner. He submits that the name of this petitioner has surfaced on the confessional statement of one co-accused Chandan Kumar. According to the confessional statement of Chandan Kumar, this petitioner was having a role in the kidnapping of the boy.

6. Having heard learned counsel for the parties and considering the fact that the name of this petitioner was not taken by the boy, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Madhepura P.S. Case no. 800 of 2024 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M., Madhepura.

7. Accordingly, the present bail application stand allowed.
