JUSTICE HARISH KUMAR ORAL ORDER 19-11-2025 Heard Mr. Binay Kumar Singh, learned Advocate for the petitioner and Mr. Chandra Bhushan Prasad, learned Additional Public Prosecutor for the State.
2. The petitioner apprehends his arrest in connection with Bahadurpur P.S. Case No. 92 of 2022, registered for the offences punishable under Sections 341, 323, 307, 504, 34 of the Indian Penal Code.
3. The allegation against the petitioner along with others is of abusing and assaulting the informant by means of lathi besides the demand of illegal money. It is specifically alleged that co-accused Shambu Manjhi assaulted the informant by means of knife over the head of the informant, due to which he sustained serious injuries.
4. Learned Advocate for the petitioner submitted that besides the fact that the occurrence took place on 19.03.2022,

The specific accusation of causing head injury is attributed to coaccused Shambhu Manjhi, who happens to be the father of the petitioner. In fact, on account of previous enmity, the name of the petitioner has been implicated in this case. So far the allegation against the petitioner of causing assault by means of lathi along with two other accused persons has not been supported by the injury report, all the more the petitioner bears fair antecedents and he undertakes that he will fully cooperate in the proceeding of the court.
5. On the other hand, learned Advocate for the State vehemently opposed the bail application and submitted that the petitioner along with others brutally assaulted the informant.

Regard being had to the submissions made by the learned Advocates for the respective parties and considering the allegation against the petitioner qua the injury report as also the fair antecedent of the petitioner and delay in lodging of the FIR, let the petitioner abovenamed be released on bail, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of

Case No. 92 of 2022, subject to the conditions laid down in Section 482(2) of the Bharatiya Nagrik Suraksha Sanhita, 2023, with the further condition that one of the bailors shall be the own/close family members of the petitioner.
