JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners seek bail in a case registered for the offences punishable under Sections 30, 38,41 of Bihar Prohibition & Excise Act 2016.

According to the prosecution case itself, the illicit spirit was recovered from the hut of accused Chandi Manjhi and so far as petitioners are concerned, admittedly nothing was recovered from their conscious possession. Petitioners do not have any criminal antecedent and even if, the prosecution story assumed to be true, then also, petitioners had no role in selling illicit spirit.

Accordingly, let the petitioners, above named, be

Patna High Court CR. MISC. No.67044 of 2019(2) dt.04-11-2019 2/2 released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XI cum Special Judge, Excise Saran at Chapra in connection with Isuapur P.S. Case No. 191 of 2019.
