JUSTICE SANJEEV PRAKASH SHARMA ORAL ORDER 23-03-2023 The petitioner, by way of the present writ petition, has prayed for as under:- "(i) To direct the respondent bank to pay the death claim of Rs.-1,00,00,000 (One Crore) of the deceased Ravindra Kumar s/o Bikram Kumar Mehta who was insured by the respondent bank.

(ii) To direct the respondent bank to do all the formalities to come into the procedure of payment as earliest time."

Learned counsel for the petitioners submits that the petitioner has already preferred a complaint before the State Consumer Disputes Redressal Commission, who has held that the complaint can be filed before the District Consumer Disputes Redressal Commission. It is further submitted that the District Consumer Disputes Redressal Commission is not

Patna High Court CWJC No.1228 of 2023(2) dt.23-03-2023 2/2 accepting the complaint of the petitioner.

If that being so, the petitioner has the remedy to approach the State Consumer Disputes Redressal Commission again and thereafter National Consumer Disputes Redrassal Commission.

As such, the present writ petition is held to be not maintainable and is dismissed with aforesaid liberty to the petitioner.
