JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 This is an application for grant of anticipatory bail in connection with Complaint Case No. 704 of 2012 disclosing offences under Sections 323, 379 and 498A of the Indian Penal Code and Section 3⁄4 of Dowry Prohibition Act. Petitioner happens to be the husband of the complainant and there is allegation of demand of Rs.50,000/- and one motorcycle and for that, she was subjected to assault and ousted her from the house.

Submission of the learned counsel for the petitioner is that as a matter of fact, she married with another person and residing with him at Darbhanga. In spite of that he is ready to keep her with dignity and care.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned S.D.J.M., Saharsa, in connection with Complaint Case No. 704 of 2012.
