1. Heard Mr. Ansul learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner seeks bail in a case registered for the offences punishable under Sections 302 and 120B of the Indian Penal Code and Section 27 of the Arms Act.

3. Learned counsel for the petitioner submits that petitioner had earlier moved this Court seeking bail by filing Cr. Misc. No. 41954 of 2024 and the same was rejected by an order dated 21.09.2024 with liberty to the petitioner to renew his prayer for bail after framing of charge. Learned counsel further submits that charges against the petitioner have been framed on 05.10.2024 (Annexure-3 to the bail application).

4. Learned A.P.P. for the State submits that in the event, if the privilege of bail is granted to the petitioner, the

Patna High Court CR. MISC. No.77649 of 2024(2) dt.26-10-2024 2/2 petitioner may abscond on which learned counsel appearing on behalf of the petitioner submits that petitioner will not abscond rather will cooperate in the trial to prove his innocence.

5. Considering the submissions aforesaid, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.50,000/- (Rupees Fifty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Gopalganj (Town) P.S. Case No. 118 of 2024.

6. One of the bailors of the petitioner shall be his brother, namely, Sahmad Hussain.

7. However, if the learned trial court comes to a conclusion that petitioner, after his release on bail, is trying to delay the trial of the case in any manner, the learned trial court shall be at liberty to cancel the bail bonds of the petitioner. (Satyavrat Verma, J) Kundan/- U T
