The petitioner apprehends his arrest in connection with Sultanganj P.S. Case no. 109 of 2019, registered under Sections 147, 149, 447, 448, 341, 323, 354(B), 379, 384 and 504 of the Indian Penal Code.

The accusation is that six persons named in the F.I.R. including the petitioner variously armed with weapons started to abuse the informant Vijay Kumar Jha and his family members and outraged the modesty of the ladies, when informant made protest, then Mohit Yadav, Sumit Yadav and Birwal Yadav started to cause assault him and at that time, they made demand ransom of Rs. One Lakh. At that time, his wife came and tried to save him and also handed over cash of Rs.

Patna High Court CR. MISC. No. 72301 of 2019(2) dt.19-11-2019 2/2 13000/-, but in spite of that they snatched her ear ring and moved from there saying that remaining amount must be paid within one week.

Learned counsel for the petitioner submits that while petitioner is named in the F.I.R., but no specific overt act has been attributed against him. Moreover, the petitioner and informant are co-villagers and only due to grudge and enmity, the petitioner has falsely been implicated in this case. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the A.C.J.M-I, Bhagalpur in connection with Sultanganj P.S. Case No. 109 of 2019, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
