2. The petitioner has prayed for bail in connection with Belaganj P.S. Case No.370 of 2025 registered for the offence punishable under Section 304(2) of B.N.S.
3. The case of the prosecution is that two unknown miscreants took the purse of the informant containing Rs. 2 Lakhs.
4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case. His name has surfaced on the statement of spy. It has further been submitted that from the possession of this petitioner, altogether Rs. 11,500/- has been recovered which
Patna High Court CR. MISC. No.73226 of 2025(2) dt.09-12-2025 2/2 belongs to the petitioner. The bag contained other articles as well, nothing has been recovered from this petitioner. He is having criminal antecedent of one case in which he is on bail. He is languishing in judicial custody since 29.06.2025.
5. Learned APP appearing for the State has vehemently opposed the application for bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in connection with Belaganj P.S. Case No. 370 of 2025.
