====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 24-10-2019 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks bail in a case for the offence registered under Sections 341, 307/34 of the IPC and 27 of the Arms Act.

The prosecution story, in brief, is that on previous day between 4.30 to 5.00 P.M., son of the informant, namely, Shubham Kumar Chaudhary with his friends were playing Badminton then all F.I.R. named accused persons including the petitioner came with two Motorcycles and started indiscriminate firing from the fire arms upon his son with intention to kill him due to which, son of the informant sustained fire arm injuries on his person.

Patna High Court CR. MISC. No.68026 of 2019(2) dt.24-10-2019 2/2 It has been submitted by learned counsel for the petitioner that the petitioner is languishing in custody since 11.06.2019. The petitioner has falsely been implicated in the present case. Charge sheet has been submitted in the present case. There is no allegation of tampering with the witnesses alleged against the petitioner. General and omnibus allegation has been made against the petitioner. No specific injury is attributed against the petitioner. The injury is on non-vital part of the body of the victim. Other co-accused has been granted bail by another Co-ordinate Bench of this Court vide Cr. Misc. No. 58992 of 2019 under order dated 27.09.2019. On behalf of the State, it is submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M. Purnea, in connection with K.Hat (Maranga) P.S. Case No. 55 of 2019.
