JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-05-2018 The petitioner is apprehending his arrest in connection with Narpatganj (Ghurna) P.S. Case No. 73/2018, registered for offences punishable under Sections 269, 270, 326 and 420 of the Indian Penal Code.

Allegation against the petitioner that he gave an injection in the leg of the informant due to which, a gangrene developed and her leg was amputated.

It has been submitted on behalf of the petitioner that informant has lodged this false case at the instance of her nephew as there was some dispute between the wife of petitioner and the said nephew of the informant and this Court has also decided L.P.A. No. 05/2017 in favour of wife of the petitioner and due to which the present false case has been lodged.

Patna High Court Cr.Misc. No.20941 of 2018 (4) dt.18-05-2018 2/2 Learned counsel for the State as well as informant opposed the prayer for bail and submitted that due to the injection given by the petitioner, the informant lost her leg. Having heard both sides, considering the facts and circumstances of the case, nature of accusation, I am not inclined to grant the privilege of anticipatory bail. This application is, accordingly, dismissed.

However, the petitioner, if so desire may surrender before the court below and make prayer for regular bail and if any such application is filed, the court below shall dispose of the same on the merit of the case, without being prejudiced by the order of this court.
