Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273/34 of the Indian Penal Code and Sections 41, 30(a) of Bihar Prohibition and Excise Act, 2016.

Neither petitioner was caught on the spot nor anything was recovered from his conscious possession and according to prosecution case itself, seized liquor was being carried by Akshay Kumar, Basant Kumar and others on three different motorcycles.
