====================================================== CORAM: HONOURABLE MR. JUSTICE ANJANI KUMAR SHARAN ORAL ORDER 20-12-2024 Heard learned Senior Counsel for the petitioner and learned counsel for the Vigilance.
2. The petitioner seeks bail in a case registered for the offence punishable under Sections 420, 467, 468, 471, 120B of the Indian Penal Code.
3. Earlier by order dated 21.11.2022 passed in Cr. Misc. No. 34165 of 2022, the prayer for anticipatory bail of the petitioner was rejected by this Court, thereafter the petitioner moved before the Hon'ble Apex Court and the same is dismissed. Thereafter, the petitioner surrendered before the learned Trial Court.
4. As per the prosecution case, allegation against the petitioner is that she got herself appointed as Niyojit
Patna High Court CR. MISC. No.82111 of 2024(2) dt.20-12-2024 2/3 Panchayat Teacher by submitting forged B.E.T.E.T., 2011 Result Card.
5. Learned Senior Counsel for the petitioner submits that no such occurrence as alleged ever took place. He is quite innocent and has been falsely implicated in this case. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. He submits that under wrong advice the petitioner filed to resign within the amnesty period granted by the Hon'ble Court. The petitioner has no criminal antecedent and has been languishing in custody since 14.08.2024.
6. Learned counsel for the Vigilance opposed the bail petition.

Considering the facts aforesaid and the fact that petitioner is a female, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned Court below where the case is pending/successor Court in connection with Nalanda P.S. Case No.63 of 2022, subject to the further condition that petitioner shall cooperate in the trial and shall be properly represented on each and every date fixed by the Court
Patna High Court CR. MISC. No.82111 of 2024(2) dt.20-12-2024 3/3 and shall remain physically present as directed by the Court and on his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the learned Trial Court.
