The petitioner seeks bail in Excise Case No.576 of 2019, registered under Section 30(a) of the Bihar Prohibition and Excise Act.
The petitioner was driving Sumo Victa bearing Registration No. BR01PA-2528 and two persons, namely, Manish Kumar and Santosh Kumar were also travelling in the same vehicle. On search, 16 bags each containing 200 pouches were recovered. About 640 litres of liquor was recovered from the vehicle.
Learned counsel for the petitioner submits that the petitioner is the driver of the vehicle. The owner of the vehicle is Santosh Kumar and he is also in custody and on his order he
Patna High Court CR. MISC. No.71525 of 2019(2) dt.04-12-2019 2/2 was driving the vehicle without knowing the fact that what was kept in the bags when the bags were being loaded in presence of the owner of the vehicle. The petitioner remained in jail for three months and petitioner has got no criminal antecedent. Considering the facts aforesaid, petitioner, above named, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Excise, Gaya in connection with Excise Case No.576 of 2019.
