Petitioner seeks bail in a case registered for the offences punishable under Sections 366A and 379/34 of the Indian Penal Code.

Allegation against the petitioner is of kidnapping and commission of rape against a minor-girl, who was daughter of the informant.

The victim has supported the aforesaid allegation in her statement under Section 164 Cr.P.C. The Doctor has also found a case of sexual assault but was of opinion that there is no sign of recent sexual assault.

Considering the nature of allegation, I am not inclined to enlarge the petitioner on bail in connection with Shikarpur Police Station Case No. 351 of 2013 pending in the court of

Patna High Court CR. MISC. No.67809 of 2019(4) dt.04-03-2020 2/2 learned Chief Judicial Magistrate, West Champaran at Bettiah. Hence, prayer for bail is refused.
