In this case, the petitioner is seeking bail in connection with Chapra Town P.S. Case No.407 of 2019 registered for offence punishable under sections 30(A), 41(i) (ii) of the Bihar Prohibition and Excise Act.

As per FIR, from a Hyundai Car, total 112.68 litres of illegal liquor has been recovered. The petitioner is in custody since 26.08.2019, having clean antecedent.

Looking to the facts and circumstance of the case, the petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of A.D.J.-XI, Saran at Chapra in connection

Patna High Court CR. MISC. No.74612 of 2019(3) dt.18-12-2019 2/2 with Chapra Town P.S. Case No.407 of 2019, subject to the condition that one of the bailors of the petitioner shall be a close relative. The petitioner will not induce any witness or tamper with the evidence. The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court. If the petitioner is found involved in future in the same offence, the prosecution will have liberty to file an application for cancellation of his bail bond.
