The petitioner apprehends his arrest in connection with Udwant Nagar P.S. Case No.222/2022, registered for the offence punishable u/s 120(B) of the IPC and 25(1-b) a 26/35 Arms Act. Allegedly, from a Black Scorpio, two barrel gun opened in two parts were recovered and two touch screen mobiles were also recovered.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence. He has been falsely implicated in this case. The name of petitioner transpired in this case on the confessional statement of apprehended person and on the basis of mobile number, which belongs to the petitioner. It is submitted that the said SIM was

Patna High Court CR. MISC. No.3152 of 2023(2) dt.17-03-2023 2/2 taken by his friend some days back. Nothing has been recovered from the conscious physical possession of the petitioner. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail. Having regard to the facts and circumstances of the case and considering that there is recovery of arms and ammunitions, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on his behalf is hereby rejected. This application is accordingly dismissed.
