2. At the very outset, learned counsel for the petitioners seeks permission to withdraw this application filed on behalf of petitioner no. 02/Md. Tasib.

3. Permission is accorded.

4. Accordingly, this application is dismissed as withdrawn filed on behalf of petitioner no. 02/ Md. Tasib.

5. The petitioner no. 01/Md. Usman @ Usman Sah apprehends his arrest in the present case registered for offences

Patna High Court CR. MISC. No.77865 of 2024(2) dt.17-12-2024 2/3 under Sections 119(2), 191(3), 190, 126(2), 115(2), 117(2), 109, 132, 121(1), 121(2) of B.N.S. Act.

6. As per the prosecution case, on 15.07.2024 at about 18:15 hours in the evening, the accused persons including the petitioner made deadly attack on the informant and other policeofficials with lathi, danda, bricks causing injuries to them.

7. Learned counsel for the petitioners submits that petitioner no. 01 is quite innocent and has not committed any offence. The petitioner no. 01 is an aged person and there is no specific allegation of assault against the petitioner no. 01/Md. Usman @ Usman Sah.

8. Learned APP for the State has vehemently opposed the prayer for bail.

9. Considering the facts and circumstances of the case, this application for anticipatory bail is allowed.

10. Accordingly, let the petitioner no. 01/Md. Usman @ Usman Sah, in the event of his arrest or surrender within four weeks from today in the Court below, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) each with two sureties of the like amount each to the satisfaction of learned Addl. Chief Judicial Magistrate, Udakishunganj, Madhepura/concerned court below in connection with

Patna High Court CR. MISC. No.77865 of 2024(2) dt.17-12-2024 3/3 Udakishunganj P.S. Case No.229 of 2024.

11. This application for anticipatory bail filed on behalf of petitioner no. 01 is allowed.
