JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-06-2018 Petitioner apprehends his arrest in connection with Ramgarhwa P.S.Case No. 242 of 2017 registered for the offences punishable under Sections 406, 409 and 420 of the Indian Penal Code.

The petitioner is a contractor and informant is Junior Engineer and allegation against the petitioner is that he has collected Rs. 200-400 from the B.P.L card holders for giving electric connection.

Submission of learned counsel for the petitioner is that he has falsely been implicated in this case and he has made complaint against the Junior Engineer because payment has not been given to him for the works done by him and this false case has been filed to create pressure upon him to quit his claim and no date has been

Having heard both sides and in the facts and circumstances, let the petitioner, named above, in the event of his arrest or surrender be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sub-Divisional Judicial Magistrate, Raxaul at Motihari, East Champaran, in connection with Ramgarhawa P.S.Case No. 242 of 2017, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further conditions are that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned.
