JUSTICE VINOD KUMAR SINHA ORAL ORDER 08-05-2018 The petitioner is apprehending his arrest in connection with Mahnar P.S. Case No. 256/2017, registered for offences punishable under Sections 4/5 of Explosive Substance Act. Prosecution case that police intercepted one person along with certain explosives, who disclosed the name of petitioner and others, who were involved in sell and purchase of the explosives. It has been submitted on behalf of the petitioner that he has falsely been made accused in this case and his name has surfaced only on the basis of confession of the co-accused and except that there is nothing against him so as to show his involvement in the present case.

Having heard both sides, considering the facts and
Patna High Court Cr.Misc. No.23646 of 2018 (4) dt.08-05-2018 2/2 circumstances of the case, nature of as well as the criminal antecedents of the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioner, this application is accordingly dismissed.
However, the petitioner, if so desire may surrender before the court below and pray for regular bail and if any such application is filed, the court below shall disposed of the same on the merit of the case, without being prejudiced by the order of this Court.
