Petitioners apprehend their arrest in a case registered for the offence punishable under sections 323, 341, 324, 325, 307, 504, 34 of the Indian Penal Code.

As per the prosecution case, all the FIR named accused persons including these person assaulted husband of the informant. Thereafter co-accused Rupesh Kumar Sah assaulted him by Dabiya, as a result of which he sustained multiple injuries.

Learned counsel for the petitioners submits that the specific allegation of assault is against co-accused Rupesh Kumar Sah and there is no general and omnibus allegation of

Patna High Court CR. MISC. No. 74874 of 2022(2) dt.06-04-2023 2/2 assault against these petitioners. Petitioners have got no criminal antecedent.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let these petitioners, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of the A.C.J.M-III, Kathiar in Falka (Pothia) P.S. Case No. 175 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
