2. This is the 2nd attempt of the petitioner. Earlier the bail application of the petitioner was rejected vide order dated 21.03.2024 passed in Cr. Misc. No. 4986 of 2024.

3. The petitioner seeks regular bail in a case registered for the offence under Sections 341, 342, 324, 307, 323, 379, 302, 506, 109 and 34 of the Indian Penal Code.

4. The following order was passed on 21.03.2024 in Cr. Misc. No. 4986 of 2024 :- Heard learned counsel for the petitioner; learned APP for the State and learned counsel for the informant.

2. The petitioner seeks bail in connection with Bettiah Town (Kalibagh O.P.) P.S. Case No. 588 of 2023 registered for the offence punishable under Sections 341, 342, 324, 307, 323, 379, 302, 506 and 109/34of the Indian Penal Code.

3. The petitioner is the assailant of the deceased. He is in jail since 30.07.2023.

4. Considering the fact that the petitioner is the assailant of the deceased, I am not inclined to grant bail to the petitioner.

5. Accordingly, this application stands dismissed.

6. If the trial is delayed, the petitioner may renew his prayer for bail.

5. The petitioner is one of the assailant of the deceased. He is said to have stabbed the deceased. The postmortem report corroborates with the prosecution case. He is in custody since 30.07.2023 and the charges have already been framed.

6. Considering these circumstances, I am not inclined to review my earlier order. Accordingly, this application for regular bail is hereby rejected.

7. The court below is directed to expedite the trial of the petitioner.

8. Learned counsel for the informant has assured this Court that the witnesses shall be produced in the trial on the date fixed. If, the trial is delayed by the prosecution the petitioner may renew his prayer for bail.
