JUSTICE VINOD KUMAR SINHA ORAL ORDER 10-01-2020 The petitioner seeks regular bail in connection with Kahalgaon (Ghogha) P.S. Case No. 647 of 2019 registered for offences punishable under Sections 188 and 290 of the Indian Penal Code as well as under Section 30(a) & 56(d) of the Bihar Prohibition and Excise Act, 2016.

Allegation is of recovery of 228.6 litres of country made liquor from the dickey of auto rickshaw of the petitioner. It has been submitted on behalf of the petitioner that petitioner is only driver and has falsely been implicated in this case and has nothing to do with the seized liquor and he has been in custody since 22.09.2019.

Heard learned A.P.P. also.

Having heard both sides, in view of the submissions

Patna High Court CR. MISC. No.71110 of 2019(2) dt.10-01-2020 2/2 as above, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II-cum-Special Judge (Excise Act), Bhagalpur, in connection with Kahalgaon (Ghogha) P.S. Case No. 647 of 2019, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds.
