In this case, the petitioner is seeking anticipatory bail in connection with Katihar Muffasil P.S. Case No.97 of 2017, registered for the offence punishable under Sections 376 and 313 of the Indian Penal Code.

Allegation has been made that while the informant went at "Kamath house" of this petitioner, where the petitioner on the point of pistol committed rape upon her and also taken a naked photograph through his mobile and on the threat of the photograph the petitioner used to establish physical relationship with the informant, due to which the informant became pregnant, thereafter, with consultation of nurse she aborted.
