1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner has renewed his prayer for grant of regular bail in connection with Kahalgaon P.S. Case no. 631 of 2023 registered under sections 304B and 34 of the Indian Penal Code.

3. As per the prosecution case, sister of the informant was married to the petitioner about one year ago. It is stated that the accused persons including the petitioner herein started to torture the informant's sister. The informant was finally informed that his sister had hung herself to death. On reaching the place of occurrence, the informant saw that she had been strangulated.

4. Learned counsel for the petitioner submits that the

Patna High Court CR. MISC. No.79334 of 2024(3) dt.10-01-2025 2/2 earlier prayer for bail of the petitioner was rejected vide order dated 26.4.2024 (Annexure-P/1) passed in Cr. Misc. no. 6841 of 2024. Inspite of the petitioner having remained in custody since 9.6.2023 the trial has still not concluded nor is there chance of the same concluding in the near future.

5. The application for bail is opposed by learned APP for the State.

6. A report was called for from the learned trial Court. As per the report received contained in letter dated 2.12.2024, four witnesses have been examined on behalf of prosecution. Two non-official witnesses and one Investigating Officer remain to be examined.

7. Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the F.I.R, the petitioner being the husband of the deceased together with the progress in the trial in the learned trial Court wherein four witnesses have been examined on behalf of the prosecution, the Court is not inclined to enlarge the petitioner on bail and the application is rejected.
