The petitioner apprehends his arrest in connection with Town Bettiah (Kalibag O.P.) P.S. Case No.291 of 2019 registered under Sections 420/34 of the Indian Penal Code besides Section 11 of the Gambling Act.

The accusation is that on receiving the secret information about gathering of Sarfaraz Khan, Iqbal Salam alias Nanhe and others for gambling near Kalibag Temple, the informant along with other police personnel reached there. On seeing the police party, the persons, who were engaged in gambling, started to flee away. While they were chased but succeeded to flee away. On the spot, two motorcycles bearing Registration No.BR22AD5819 and BR05B6866

Patna High Court CR. MISC. No.70760 of 2019(2) dt.05-02-2020 2/2 were found. On query, the persons, who were present there, disclosed the name of Sarfaraz Khan, Iqbal Salam alias Nanhe Mian, Santosh Patel and Suraj Kumar, who were indulged in gambling and succeeded to flee away.

Leaned counsel for the petitioner submits that, in fact, the petitioner had gone to temple for offering 'Puja' boarding on his motorcycle and when he was offering Puja in the temple, after parking his motorcycle on the road, his motorcycle bearing Registration No.BR22AD5819 was also seized by the police. Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of his arrest or surrender by him within six weeks from today, be enlarged on bail on his furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah (West Champaran), in connection with Town Bettiah (Kalibag O.P.) P.S. Case No.291 of 2019, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
