The petitioner has filed the instant application for grant of regular bail in connection with Barahat P.S. Case No. 114 of 2022 registered under sections 25(1-b)a/26/35 of the Arms Act.

Prosecution case relates to recovery of one country made pistol along with 4 live cartridges from the possession of the petitioner.

Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. He has falsely been implicated in this case due to village politics and land dispute. It is further submitted that he has no concern with the recovered arms. There is no independent witness of alleged

The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case as well as the custody of the petitioner, the Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail in connection with Barahat P.S. Case No. 114 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court of C.J.M., Banka.
