2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 406, 420/34 of the Indian Penal Code.

3. As per allegation in the FIR, informant runs an online banking under the name and style of Bitcoin fortune and in order to collect money he engaged several agents. Allegedly petitioner has misappropriated huge public money in connivance with other accused persons. It is further alleged that accused persons along with their family members have fled away from the village to some unknown place.

4. It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.75956 of 2023(2) dt.01-12-2023 2/3 that petitioner has been falsely implicated in this case. Total 66,000/- has been transferred in the account of petitioner by Manohar Kr. Choudhary. It is pointed out that said money was taken as loan from him to which petitioner has already returned by transferring Rs. 46,500/- in bank account and rest remaining amount was setteled for grocery items which was taken by manohar Kr. Choudhary of credit from his shop. Petitioner is not named in the FIR. Petitioner is languishing in judicial custody since 13.6.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned ACJMI, Dalsingsarai (Samastipur) in connection with Dalsingh Sarai P.S. Case No. 195 of 2021.
