The petitioner seeks anticipatory bail in connection with Amarpur P.S.Case No. 593 of 2017, registered for offences punishable under Sections 406 and 420 of the Indian Penal Code. Allegation against the petitioner is that he has withdrawn an amount of Rs. 48,500 and Rs. 55,000 from the account of the informant, Ushan Devi and Urmilla Devi, Bihar Gramin Bank, Amarpur, Banka on forged and fabricated signature.

Submission of the learned counsel for the petitioner is that on perusal of para-25 of the case diary, it appears that Urmilla Devi and Usha Devi had taken loan from the Bank but did not return and in order to save him, present case has been lodged. It is also submitted that the petitioner has no criminal antecedent.

Patna High Court Cr.Misc. No.17407 of 2018 (3) dt.19-06-2018 2/2 Learned A.P.P. opposes the prayer for bail . Having heard both sides and in view of the facts and circumstances, let the petitioner above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order, be released on bail on furnishing bail bond of Rs. 25,000/- ( Twenty five Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S.Case No. 593 of 2017, subject to the condition that as laid down under Section 438 (2) of the Code of Criminal procedure with condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned court and the petitioner shall co-operate in the investigation of the case and make himself available as and when required by the Police, otherwise, the prosecution is free to move for cancellation of his bail bond.
