JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-11-2019 Petitioner seeks bail in anticipation of his arrest in connection with Rosra P.S. Case No. 153 of 2019 registered for the offences punishable under Sections 307, 323, 34, 341, 386, 447 and 504 of the Indian Penal Code.
As per FIR there is allegation of demanding extortion against petitioner and other accused persons and there is also allegation of assaulting the son of informant by belt and informant has given Rs.1.7 lac to the petitioner. Submission of learned counsel for the petitioner is that the real fact is that informant is interested in purchasing a land situated behind his shop which belongs to the petitioner and for that he has assaulted the petitioner and other accused persons and for that wife of petitioner has lodged a case against
Patna High Court CR. MISC. No.71019 of 2019(2) dt.07-11-2019 2/2 the informant and that apart injury is simple in nature. Heard learned APP also.
In view of above facts and circumstances, let petitioner, in the event of arrest or surrender, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-I, Rosra in the District of Samastipur, in connection with Rosra P.S. Case No. 153 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioner shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
