The petitioner seeks anticipatory bail in connection with Nokha P. S. Case No. 61 of 2018, registered for offences punishable under Sections 379, 411 and 413 of the Indian Penal Code.
The petitioner is not named in the F.I.R. and it appears that one motorcycle was intercepted and co-accused has been admitted the fact that it was a stolen motorcycle, which was being brought by the petitioner after commission of theft and the motorcycle was parked in Dalan, was recovered. Submission of the learned counsel for the petitioner is that the motorcycle has been recovered from the road and not from the Dalan of the petitioner and the petitioner has no criminal

Learned A.P.P. opposes the prayer for bail.
In such view of the matter, let the petitioner, above named, I am not inclined to grant anticipatory bail to the petitioner. Accordingly, prayer for anticipatory bail is rejected with a direction to the petitioner that if the petitioner surrenders before the Court below and makes prayer for regular bail, the same will be considered by the learned court below on its own merit without being prejudiced by this order of this Court. With the aforesaid observation, this application is disposed of on the same day.
