JUSTICE VINOD KUMAR SINHA ORAL ORDER 22-06-2018 The petitioner is apprehending his arrest in connection with Dagarua P.S. Case No. 45/18, registered for offences punishable under Sections 409, 420, 467, 468, 471, 120(B)/34 of the Indian Penal Code.

Allegation as per F.I.R against the petitioner, who happens to be a Block Development Officer is irregularity during in Dagarua Anchal during heavy flood in the year 2017. It has been submitted on behalf of the petitioner that no irregularity has been done and as a matter of fact that there were two types of kitchen were maintained in the year during flood, one is camp kitchen and another is community kitchen and he has maintained the register /voucher with regard to camp kitchen and there is no provision of maintaining register / voucher with regard to community kitchen.

Patna High Court Cr.Misc. No.25656 of 2018 (3) dt.22-06-2018 2/2 Heard learned A.P.P. also.

Having heard both sides, considering the facts and circumstances of the case, nature of offence and also that petitioner has no criminal antecedent and only general and omnibus allegation has been levelled against him, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned ACJM -II, Purnea in connection with Dagarua P.S. Case No. 45/18, subject to the conditions as laid down under Section 438(2) of the Cr.P.C, as well as subject to the condition that the petitioner shall cooperate in the investigation and make himself available as and when required by the police along with all relevant documents, failing which, the prosecution shall move for cancellation of his bail bonds.

It is also made clear that if any serious incriminating material comes against the petitioner, the prosecution will move for cancellation of his bail bonds.
