JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-10-2019 Petitioner seeks bail in anticipation of his arrest in connection with Turkauliya P.S. Case No. 451 of 2019 registered for the offence punishable under Section 30(a) of Bihar Prohibition and Excise Act.

Allegation is of recovery of 123.84 litres from the orchard and villagers have named this petitioner. Submission of learned counsel for the petitioner is that he has falsely been implicated, having no criminal antecedent.

Heard learned APP, who has opposed the prayer for anticipatory bail of the petitioner.

In view of above facts and circumstances, I am not inclined to grant the privilege of anticipatory bail to the

Patna High Court CR. MISC. No.67073 of 2019(2) dt.23-10-2019 2/2 petitioner. However, if petitioner surrenders and pray for regular bail, the same shall be considered on the basis of materials available on the record so far identification of the petitioner is concerned and considering the same the court below shall pass an appropriate order.

This application is, accordingly, dismissed.
