The petitioner is seeking anticipatory bail in connection with Excise Case No. 441 of 2019 registered under Sections 30(a) of the Indian Penal Code, pending in the court of learned 9th Additional Sessions Judge - cum - Special Judge, Excise, Motihari, East Champaran.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case, specific recovery is not mentioned in the official complaint, petitioner has no concern with the alleged illicit liquor. Learned A.P.P. for the State has opposed the prayer for anticipatory bail of the petitioner.

No.69107 of 2019(2) dt.27-11-2019 2/2 Considering the facts and circumstances of the case wherein it is found that the illicit liquor has been recovered from the house of the petitioner, this court is not inclined to grant privilege of anticipatory bail to the petitioner. Prayer for anticipatory bail of the petitioner is refused. In case, petitioner surrenders and prays for regular bail in the court below within a period of four weeks from today, his prayer for regular bail shall be considered on it's own merit without being prejudiced by the order of this court.
