2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 392 of the Indian Penal Code registered in connection with Manigachhi P.S.Case No. 279 of 2022.

3. As per allegation, while the informant was travelling from Koelwar to Hajiur by his bike, three masked persons intercepted him within the jurisdiction of Manigachhi police station and at the point of pistol, they looted away his bike, a Samsung mobile and cash of Rs. 4400/-.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated. He is in custody since 31.11.2022. Except his

No.86713 of 2024(6) dt.09-04-2025 2/2 confessional statement, there is nothing against him and the confessional statement is not leading to recovery, as such, it is not admissible in evidence. The learned counsel has also submitted that he has been implicated only on the ground of his criminal antecedents, which have been mentioned in para-3 of the bail petition.

5. It appears that except the confessional statement, which is not leading to recovery, there is nothing against the petitioner in the present case. He is in custody for more than two years.

6. Considering the above facts and circumstances, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Darbhanga in connection with Manigachhi P.S.Case No 279 of 2022, subject to the condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
