The petitioner seeks bail in connection with Lalganj P.S. Case No. 243 of 2019, registered for the offence under Section 363/34 of the Indian Penal Code and later on Section 364 of the Indian Penal Code was also added.

The accusation is that Aditya Raj, aged about 9 years, son of the informant Ajay Kumar Sah, was sitting at his jewellery shop. When the informant searched at the shop, he did not find his son there and started searching his son, but no trace was found. The informant raised suspicion that his son was kidnapped by Sonam Kumari(petitioner).

Submission is that the Mayaka of the petitioner is in

Patna High Court CR. MISC. No.67430 of 2019(2) dt.27-11-2019 2/2 village-Amritpur, Police Station- Vaishali, District- Vaishali, which is also the village of the informant. In the marriage of the petitioner, her parents had purchased some jwellery from the shop of the informant, but ornament was of sub-standard and complaint was made by the petitioner and her parents. Due to that reason, the informant has falsely implicated the petitioner in this case. It is further submitted that the son of the informant was found in the market in the evening of the day of the occurrence. The petitioner, who is a lady, has no criminal antecedent and she is in custody since 16.07.2019.

Having considered the facts and circumstances of the case, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M. XIV, Vaishali at Hajipur in connection with Lalganj P.S. Case No.243 of 2019.
