2. The petitioner seeks regular bail in connection with Hisua P.S. Case No.361 of 2023 registered under Section 379 of the Indian Penal Code.

3. As per the prosecution case, it is a case of theft of a Bolero vehicle of the informant bearing registration No. BR27A-5041.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence. The petitioner has falsely been implicated in this case. He further submits that he has been made accused in this case by virtue of suspicion only and petitioner is in custody since 26.08.2023 and no recovery has been made from his possession. The petitioner was produced and taken into custody from a different case.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail on fur-
