2. The petitioner is apprehending his arrest in connection with Kuchaikote P.S. Case No. 229 of 2024, F.I.R. dated 29.05.2024 for the offences punishable under Sections 363, 366(A) of the Indian Penal Code.

3. According to prosecution case, the petitioner abducted informant's two daughters namely Muskan Khatoon and Rukshar Khatoon on the pretext of marriage.

4. Learned counsel for the petitioner submits that petitioner has clean antecedent and he has falsely been implicated in the present case. He further submits that the

Patna High Court CR. MISC. No.80606 of 2024(3) dt.17-04-2025 2/3 allegation as alleged in the F.I.R. is false and fabricated and the petitioner has not committed any offences as alleged in the F.I.R.

The learned Additional Public Prosecutor has vehemently opposed the prayer for bail of the petitioner and submits that although victims were recovered and their statement were recorded under Section 164 of Cr.P.C/183 of BNSS, 2023 and from a bare perusal of their statements which suggest that victim, namely, Rukshar Khatoon has stated that the petitioner has made physical relation with her and apart from that, the investigating officer has produced the date of birth certificate of the victims which suggest that the date of birth of victim, namely, Muskaan Khatoon is 06.04.2007 and date of birth of victim, namely, Rukshar Khatoon is 20.06.2009 which suggest that on the date of occurrence both the victims were minor and the statement of the victims have not supported the case of the prosecution and the consent of the minor has no concern in the eyes of law.

6. Considering the aforesaid facts and the nature of allegation against the petitioner, I am not inclined to grant the privilege of anticipatory bail to the petitioners in connection with Kuchaikote P.S. Case No. 229 of 2024 pending in the court
