JUSTICE VINOD KUMAR SINHA ORAL ORDER 18-06-2018 Petitioner apprehends his arrest in connection with Ramnagar P.S.Case No. 480 of 2017 registered for the offences punishable under Sections 353, 341, 323, 307, 414, 332, 333 of the Indian Penal Code and 27 of the Arms Act.

Allegation as per FIR is that police raided the place on information that theft wood was kept there and in the meantime a tractor was passing through and seeing the police party the person on the tractor started firing on the police party and one person was apprehended and he named this petitioner.

Submission of learned counsel for the petitioner is that nothing was recovered from the possession of the petitioner and he is tractor driver and he has no criminal antecedent also. Heard learned APP also.

Patna High Court Cr.Misc. No.17890 of 2018 (4) dt.18-06-2018 2/2 Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner.

However, if the petitioner surrenders and make prayer for regular bail, the same shall be considered without being prejudiced by this order, if possible, on the same day.
