1. Heard learned counsels for the parties.

2. This application has been filed for restoration of Cr. Misc. No. 42756 of 2023, which stood dismissed due to noncompliance of peremptory order dated 28.07.2023. By the said order, two weeks' time was allowed to learned counsel for the petitioner to file requisites of notice, issued to opposite party no. 2, but it was not filed within stipulated time.

3. It is submitted by learned counsel for the petitioner that due to inadvertence, the requisites could not be filed within stipulated period, rather it was filed on 06.12.2023.

4. In view of reasons assigned in the application, this
