Petitioners apprehend their arrest in Parbatta ( Maraiya ) P.S. case no. 425 of 2017 instituted for the offence under Section(s) 363 and 365/34 of the Indian Penal Code and Section 9/10 of Prevention of Child Marriage Act, 2006. Learned counsel for the petitioners submits that the marriage of son of the informant with sister-in-law of Ajay Choudhary has already been performed and both are living
Patna High Court Cr.Misc. No.16145 of 2018(3) dt.08-05-2018 2/3 together.
In the written report, there is specific allegation against coaccused Ajay Choudhary of taking away the son of the informant on his motorcycle and performing the marriage with his sister in-law. The petitioner no.1 is friend of Ajay Choudhary and petitioner no.2 is father-in-law of Ajay Choudhary. In the facts and circumstances of the case, prayer of the petitioners for grant of anticipatory bail is allowed. In the event of surrender/arrest of the petitioners, named above, within six weeks from today in connection with Parbatta ( Maraiya ) P.S. case no. 425 of 2017, they shall be released on anticipatory bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-I, Khagaria, subject to the conditions as laid down under Section 438(2) Cr. P.C.
Patna High Court Cr.Misc. No.16145 of 2018(3) dt.08-05-2018 3/3 prosecution will be at liberty to move for cancellation of bail of the petitioners.
