JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-10-2019 This application, for grant of anticipatory bail, arises out of Buxar (Ind.) P.S. Case No. 111/2019 disclosing offences under Sections 25(1-B)a/26/35 of the Arms Act and Section 30(a) of Bihar Prohibition and Excise (Amendment) Act 2018. Allegation as per F.I.R. is that police on secret information that liquor and arms were kept in the house of coaccused Gopi Upadhyay, raided the house of said Gopi Upadhyay and recovered huge quantity of liquor as well as one country made pistol from the Gopi Upadhyay and from another co-accused Dinesh Yadav, one cartridge was recovered. Submission of learned counsel for the petitioner is that he has falsely been implicated in this case only on the basis of confession of co-accused and except that there is nothing against the petitioner and he has no criminal antecedent.

Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned A.D.J.-II-cum-Special Judge, Excise Act, Buxar, in connection with Buxar (Ind.) P.S. Case No. 111/2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
