2. The petitioner has preferred this application for grant of regular bail in connection with Bikram P.S. Case No. 304 of 2025 dated 14.07.2025 registered for the offences punishable under Sections 115(2), 126(2), 74, 123, 351, 352 read with Section 3(5) of the B.N.S.

3. As per the prosecution case, the informant alleged that on 14.07.2025, the petitioner and the co-accused persons beat her mother. It is further alleged that on 07.07.2025, with the help of police, the informant and her mother were returned to Katari along with her brother and his brother-in-law. She was not allowed to cook food nor they given anything to eat and they administered Sulpas powder to the informant. Then the informant informed about the incident through phone to her brother-in-law then he dial 112 from his phone. Thereafter, police took the informant along with her mother to Bikram, P.H.C. from where she was referred to AIIMS, Patna for better treatment. Earlier also the petitioner tried to outrage her modesty.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case due to previous dispute. The petitioner is the uncle of the informant and both the parties are gotiya. The occurrence took place on 07.07.2025 but the FIR was lodged on 14.07.2025 and there is no explanation for this delay. The charge-sheet has been submitted against the petitioner. There is no specific allegation against the petitioner. The petitioner has no concern with the alleged offence. The petitioner has two criminal antecedents as stated in para 3 of the bail petition. The petitioner is in custody since 11.07.2025.

5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances

No.73065 of 2025(2) dt.17-11-2025 3/3 of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna at Danapur in connection with Bikram P.S. Case No. 304 of 2025, with a condition:- (i) The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner are liable to be cancelled.

7. The application stands allowed.
