Petitioner apprehends arrest in a case registered for the offence punishable under sections 363, 365, 366 (A) 34 of the Indian Penal Code and 8/17 POCSO Act.
As per the prosecution case, all the FIR named accused persons including this petitioner abducted the minor daughter of the informant.
It is submitted by the learned counsel for the petitioner that the petitioner is quite innocent and has falsely been implicated in this case due to land dispute. He further submits that the main accused Sonu Yadav has solemnized
Patna High Court CR. MISC. No.10429 of 2023(3) dt.20-06-2023 2/2 marriage with the victim girl. Petitioner has got no concern or any relation with co-accused Sonu Yadav. Similarly situated coaccused persons have already granted bail by this Court vide order dated 19.05.2023 passed in Cr. Misc. No. 10013 of 2023. Learned counsel for the State and informant vehemently opposes the bail petition of the petitioner. Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Court below Supaul or C.J.M Supaul in connection with Chhatpur P.S. case no 107 of 2021, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
