JUSTICE SHIVAJI PANDEY ORAL ORDER 12-10-2020 Heard Mr. Man Mohan Kumar, learned counsel for the petitioner and Mr. Arvind Kumar Pandey, learned counsel for the State as also Mr. Madanjeet Kumar, learned counsel for the Informant.

In view of the earlier order of this Court dated 2.8.2019 passed in Cr. Misc. No. 48238 of 2019, the petitioner was ready to carry his wife to her matrimonial house and keep her as wife with full dignity and honour and this Court had fixed the date as 18.8.2019 to appear before the court below but, he failed to appear there.

The petitioner has filed the present application for

25672 Patna High Court CR. MISC. No.70539 of 2019(5) dt.12-10-2020 2/2 modification of the aforesaid order dated 2.8.2019 for extension of time to carry out the same.

Looking to the explanation given by the petitioner, let the petitioner should appear before the court below on 31.10.2020 and, in turn, the opposite party no.2 will also remain present there and, as per undertaking given by the petitioner, he will carry his wife to her matrimonial house and will keep her as wife with full dignity and honour.

Accordingly, the order dated 2.8.2019 passed in Cr. Misc. No. 48238 of 2019 is modified to the extent indicated above.

This application stands disposed of.
