The petitioners are apprehending their arrest in connection with Pupri P.S.Case No.44/17 registered for offences punishable under Sections 366A and 363 of the Indian Penal Code. Allegation against the petitioner is that is of kidnapping the informant.
Submission of the learned counsel for the petitioner is that the girl has appeared in the court and filed a petition that the prosecution case is false and she has love affair with Amresh Kumar, with whom she want to marry and she has not supported the prosecution case.
Heard learned A.P.P. also.
Patna High Court Cr.Misc. No.19909 of 2018 (3) dt.25-04-2018 2/2 Having heard both sides and from perusal of the impugned order, it appears that the girl is still traceless, in such view of the matter, let the petitioner surrender before the learned court below within a period of four weeks from the date of receipt of the order and make prayer for regular bail and the learned court below will consider the petition filed by the victim girl and if possible he will call upon the girl and examine her personally and if the submission of the petitioner is found true, the learned trial court will pass appropriate order without being prejudiced by the order of this Court.
