Petitioner apprehends arrest in a case registered for the offence punishable under sections 379, 411 of the Indian Penal Code and 56(i), 56ii) of Bihar Mines Mineral Concession rule and sections 33, 41, 42, 52 of Forest Act. As per the prosecution case the petitioner is owner of the tractor which was found carrying illegal stones (boulders). Learned counsel for the petitioner submits that the petitioner has been roped in this case only because he is owner of the said tractor. At the relevant time, it was being driven by the son of the petitioner. Petitioner is 73 years old senior citizen. Petitioner has got no criminal antecedent.

Considering the aforesaid facts and circumstances of

No.74878 of 2022(2) dt.06-04-2023 2/2 the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned C.J.M.
