JUSTICE VINOD KUMAR SINHA ORAL ORDER 19-12-2019 This application, for grant of anticipatory bail, arises out of Chautham P.S. Case No. 28 of 2019, disclosing offences under Sections 273, 120B/34 of the Indian Penal Code and Section 30(a) of the Bihar Prohibition of Excise Act, 2016. Prosecution case is of recovery of huge quantity liquor from the truck and it is alleged that petitioners succeeded in fleeing away.

Submission of learned counsel for the petitioners is that they are not named in the F.I.R. and they have been made accused in this case on confession of co-accused and except that there is nothing against the petitioners.

Heard learned A.P.P. also, who has opposed the prayer

Patna High Court CR. MISC. No.67344 of 2019(3) dt.19-12-2019 2/2 for anticipatory bail on the ground that in this case there is recovery of huge quantity of liquor and petitioner no. 1 is also accused in one more case of similar nature.

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Special Judge Excise Act, Khagaria, in connection with Chautham P.S. Case No. 28 of 2019, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.
