JUSTICE MOHIT KUMAR SHAH ORAL ORDER 21-04-2023 The learned counsel for the Respondent-State has produced the final order, passed under Section 6(1) of the Bihar Public Land Encroachment Act, 1956, dated 15.2.2023, in
Patna High Court CWJC No.2626 of 2023(3) dt.21-04-2023 2/2 connection with Encroachment Case No. 14 of 2022-23, by the Circle Officer, Madhuban, which is directed to be kept on record.
The learned counsel for the petitioners seeks liberty on behalf of the petitioners to file appropriate appeal, challenging the aforesaid order dated 15.2.2023, as per the provisions contained in the Bihar Public Land Encroachment Act, 1956, however, seeks some protection during the interregnum period. Liberty, so sought, is granted. It is needless to state that in case, appropriate appeal is filed within a period of two weeks from today, no coercive steps shall be taken against the petitioners till the disposal of the appeal in question.
The writ petition stands disposed off on the aforesaid terms.
