The petitioner has filed the instant application for grant of regular bail in a case registered for the offences punishable under Sections 366(A)/34 of the Indian Penal Code.

The prosecution case in nutshell is that when the informant's daughter did not return from her school, informant began to search for her and he came to know that petitioner along with other co-accused persons have abducted his daughter.

It is submitted by learned counsel for the

Patna High Court CR. MISC. No.73954 of 2022(2) dt.21-03-2023 2/3 petitioner that the petitioner is innocent and he has falsely been implicated in the present case. The victim recovered and she has not whispered about the complicity of petitioner in her elopement, in her statement recorded under Section 164 of Cr. P.C. She has stated that she has called the petitioner from mobile phone and went with him to Jagdamba Asthan, Patna and solemnized marriage with him out of her own sweet will. It is further submitted that according to medical report, age of victim is 18-19 years. Only considering the minority of the victim, prayer of petitioner was rejected by the concerned Court. Moreover, the petitioner is languishing in judicial custody since 05.10.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent. Learned APP appearing for the State has vehemently opposed the prayer for Bail.

Having heard learned counsel for the parties and taking into consideration the facts and

The above named petitioner is directed to be enlarged on bail in connection with Laheri P.S. Case No. 482 of 2022 on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nalanda, Bihar Sharif.
