JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 04-11-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 30(a) of Bihar Excise and Prohibition Act.

The alleged recovery is said to have been made from the house of co-accused Shesh Kumar and so far as petitioner is concerned, it is said that the petitioner and some other coaccused were arrested from the place of occurrence. Submission on behalf of the petitioner is that petitioner had gone to the house of co-accused Shesh Kumar to invite him on the occasion of marriage of his niece but unfortunately, he was caught by the police. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Special Case No. 7551 of 2019 arising out of Fatuha P. S. Case No. 567 of 2019.
